I think there are places where you can get kits that let you change your own iPod batteries (I know they exist, actually, I've seen them in passing but don't have the links).

EDIT: The hands free phones are still not for driving; it's the split attention that is the problem moreso than something in your hand (why cheeseburgers in our hands don't cause as many accidents as cellphones or blowjobs).
