SALINAS, Calif. (AP) -- A Salinas man will have to choose between going to jail or joining the military as his punishment for possession of marijuana. A judge surprised both the prosecution and defense yesterday when he told Brian Barr that he could avoid a jail term by enlisting in the military. The 24-year-old Barr was charged with marijuana possession after shooting a would-be robber who had entered his apartment with two others. More...

He can join the Navy and just keep crapping in his pants in boot camp until they put him in the Special Training Division (it won't take long for them to transfer him there when he's marching around with shit dribbling down his legs all the time). STD is where they put the psychos, kleptomaniacs, people who forgot "not to tell" etc. until they can process their discharge papers. If he sticks to it he may even get a nice section 8 discharge with gov benefits and some pension money.

Easy choice. I smoked pot the whole time I was in the navy, sold some too. Lots of stoners there, even more trippers, and in San Diego, even more meth addicts (fuck meth). Plus you get the chance to go get fucked up and fucked by nice whores around the world. Duh. Get the shit beat out of me and fucked up the ass with no drugs or go wage war around the world. He should join the NAVY. One of my supervisors was the shit as far as the USN was concerned, but he chose the Navy over jail also. He was a coke dealer before.

often they take people like that out back of the BEQ and beat the crap out of them until they straighten up. In the "new Navy" drill instructors are not allowed to physically touch or use indecent language on the recruits (our Company Commander asked our "permission" to call us "fuck nuts" and we said yes without hesitation). But that doesn't mean that your fellow recruits won't beat the crap out of you after lights out. When one person is fucking up everyone has to suffer( watch Platoon if you don't know what I'm talking about). The defecation routine takes some intestinal fortitude to pull off and your fellow recruits will be less likely to beat on you if it means getting excrement or urine on them But like Realschmeal says the Navy is a good place to be if you want to travel around the world, get fucked up on every drug imaginable and collect venereal diseases...that's what I did for 6 years.

That's really f'ed up. is it good for the military to send them someone who would obviously be avoiding a prison sentence? I don't think he will have the dedication, nor should he have the dedication, to be of benefit to any branch of the military. Why did they search his house? That really blows. the man was trying to protect his house and he gets busted.

The fact that he got arrested for possession while defending his home from robbers is BS, the sentencing however...I dunno, at least they gave the guy a choice. I feel it might even be a good idea. Think about it, you get busted for possession of a large amount of whatever and they find you guilty...they then give you a choice, lengthy prison sentence or the option to join the military. If there is someone so opposed to the military they'd rather go to jail, they can. If they want to avoid prison by whatever means possible, they can. Sure, it is the military and I hear it really blows, but at least it's a choice.

As far as this guy goes, it could be worse: In PA, a guy shot one of 2 ARMED thieves and was charged with attempted murder. I realize that there are certain specifics that have to be met in order to make a situation qualify for "self-defense" (which this did), but the guy still wound up going to jail. |

Unless the assailants are likewise armed with the heat the assailed has, shooting them in the knees would be the assailed's best bet to evade an "attempted murder" charge. Then again, a larcinest can break into your home, steal your shit, and then slip on your front porch and sue you for it, so who really knows when it comes to the courts? My favorite part is the "beyond the shadow of a doubt" portion; almost instills me with some faith in it.

| ~I know that in some states, such as Arizona, if a person breaks in your house and you FEEL threatened you can shoot them. Any decent lawyer will be able to convince a jury that you felt like your life is endangered. I have spoken with several lawyers about this and they all told me that if I did kill someone who broke into my home, given you did not shoot them 8 times and reload, you would spend no jail time. ~Another point is that there is no information given about what happened and why. I would bet that it involved drugs, guns, and a deal gone wrong. Not many judges like these things.} ~The two options suck, but in the military you get paid and there are many loop holes. ~P.S. it does not matter where you shoot them, it is still attempted murder with a deadly weapon. | What about joining the Coast Guard. It's a branch of the military with great benifits, not the least of which is learning how the anti-drug trade works. Plus see other places that know one even dreamt that there were Coast Guard.. It's interesting that this was an alternative. I was not aware the any portion of the military services were accepting people from the court system. The all voluntary military made the services very discrinating. Know thy enemy, sometimes he or she can look just like you. |

Ive heard of this case from a friend... or perhaps it is just a very similar one. The guy dosen't have a choice, it is the Army or jail. His older brother wants to enlist on the condition that he dosen't have to be seperated from his younger brother. Not much chance of that, in my opinion. Makes me want to cry.
